4:00 - Business Meeting & Conservation Agent's Report

Tim Smith of the National Seashore and Jim Tang of Marine Biological Laboratory located in Woods Hole, came before the Commission to report on a previously approved RDA for monitoring carbon dioxide and methane emissions within the Herring River.  Mr. Smith stated additional equipment will be installed by Way 672 (Rainbow Lane) within the Phragmites.  The physical disturbance will be stakes and cables to support the equipment.  A comparison will be made for the Wellfleet location and marsh areas at Sandy Neck. Electrical power will come from a solar panel.

Jurisdictional Opinions

            Roland, 45 Wellesley, (36 /55) , new well which is located 90’ from the beach area.  Portable drilling equipment will be used.  Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 5-0.   

            Alexander, Wigwam Street, locate an air conditioner unit on a concrete pad 30” by 30”.  He also wanted a concrete pad for propane tanks for which he will file an RDA in the future.  Lauren McKean moved to approve the Jurisdictional Opinion; seconded by John Portnoy; passed 5-0.

Agent Greenberg-Lemos is following up with the Jurisdictional Opinion for Bartlett on 50 Steel Road regarding tree trimming.

Regulations Overview.  The Commission reviewed and suggested revisions to the Wellfleet Environmental Regulations, specifically regarding  fees and special considerations for  ecological restoration projects.    

Trudy Vermehren would like to be able to have some follow up on Orders of Conditions issued when materials are delivered to a site that may include invasive weeds such as Japanese knot weed.  Discussion took place about conditions being added to future Orders of Conditions, with follow up before a Certification of Compliance is issued.

                                 

Public Hearings 5:00 pm:

Wellfleet Environmental Protection Regulation Revisions  Trudy Vermehren moved to approve the revisions made to the Environmental Protection Regulations,  effective June 21, 2017 (small vessels regulations effective immediately); seconded by Barbara Brennessel; passed 5-0.

Thompson/Romano, 5 Holbrook Ave., Map 1 Parcel 105, NOI, demolish and rebuild dwelling with new foundation.  David Lajoie represented the applicant, who are the new owners of the property.  The building will be replaced and the septic system will remain.  The resources were identified as shown on the site plan.  There will be a new compliant foundation installed.  The dwelling will remain on the same footprint.  John Portnoy noticed that there is fill on the property and he would like to see it removed to the extent of mapped hydric soils.  Agent Greenberg-Lemos stated she would like to see a new hydric  soil delineation performed since the site plans from previous hearings are not matching the site plan presented with this application.  She also requested the current disturbance on the property be identified as well as what is proposed.  There is an enforcement order to remove the sheds.  Alfred Pickard questioned the new parking requirements and he questioned David Lajoie about the flood zone in the A zone 3” below the first floor and stated he and his family would support the project.  There was discussion regarding the elevations of the leach area, ground water, and the depth of the materials brought into the property.  The owners are proposing to connect to Town Water.  A new site plan will be presented at the next meeting.  David Lajoie requested a continuation to June 7, 2017; seconded by John Portnoy; passed 5-0.         

Stewart, 26 Whereaway Lane, Map 15, Parcel 148.3B, RDA, curb cut/lot access to Route 6.  Mr. Stewart stated the subdivision has been approved by the Planning Board, and has submitted a curb cut / lot access to Route 6.  The access is within the 100’ buffer zone.  Trudy identified the RDA as a Negative 3; seconded by Ginie Page; passed 5-0.

Rose, 55 Pine Ave., Map 29, Parcel 405, RDA, install new slider, install small dormer on roof, board up existing door.  Jeff Rose and Nathan Brittinal came to the table and gave an overview of the project.  Rose stated there is a living room and bedroom on the back side on the right.  They want to reverse the location of the rooms to the left side of the house and will require new doorways.  Lauren McKean identified the RDA as a Negative 3; seconded by BB; passed 5-0.  Need green cards to DEP / receipt before paperwork can be provided. 

Trudy Vermehren moved to adjourn at 5:50 pm; seconded by Ginie Page; passed 5-0.
