4:00 - Business Meeting & Conservation Agent's Report

Mail / Discussion 

            Conservation Restriction:  Hamblen Farm – Sue Anthony and Denny O’Connell came to the table.   Denny stated it is at the State level for approval.  Ginie Page had to recuse herself.  Denny stated he requires a Municipal Certificate from the Conservation Commission stating they endorse the restriction.  1.8 acres.   Barbara Brennessel moved to approve the Conservation Restriction for 149 Hamblen Farm Road, seconded by John Portnoy; passed 4-0.

Letter from Doug Guey-Lee to Martha Field regarding violation for placement of snow fences at base of coastal bank north of Lecount Hollow Beach, which alters the resources and was advised to remove the fencing.

Discussion on revised regulations.  Barbara Brennessel stated there should be something in the regulations for dock and piers.  There was further discussion regarding reduction of the 5,000 square foot limit of buffer zone disturbance.  John Portnoy asked whether the regulations would allow a more favorable determination for maintaining a food garden, versus a lawn, in the buffer zone of a wetland.   Doug will check with Hillary Greenberg-Lemos regarding having another meeting prior to the May 4 public hearing and report back to the commission.    

Jurisdictional Opinions -  The Pearl Restaurant is proposing a waiting area which will be fenced off from the general public, eliminating two parking spots.  Drinks are allowed in the area, but there will be no service provided.  There will be seating.  The commission expressed concerns with paper/plastic materials going into the creek.  John Portnoy moved to approve the JO; seconded by Barbara Brennessel with the condition if any litter or materials go into the creek area, the waiting area can be removed.

Public Hearings 5:00 pm:

McDonald, 125 Peace Valley Rd., Map 8, Parcel 238, NOI, Septic and well (Cont’d).  The commission was waiting for a response from Natural Heritage.  A letter was received.  Ginie Page moved to approved the NOI; seconded by Barbara Brennessel; passed 5-0.

Bartsch, 80 Aunt Sarah’s Way, Map 42, Parcel 57, NOI, addition (Cont’d).  Gordon Peabody represented the applicant.  Mr. Bartsch gave an overview of the proposed work and explained how the work will be encroaching on the buffer zones.  There will be 2,700 square feet within the buffer zone.  Gordon Peabody reviewed the disturbed areas, the mitigations, and the proposed planting plan.  John Portnoy noted that has been a long history of wetland cutting  on the property and would like to see some additional highbush blueberries planted within the lower area.  Gordon Peabody will submit a revised plan identifying the plantings in the lower areas.  Mr. Bartsch requested there not be a split rail fence along the marsh.  Lauren McKean moved to approve the NOI; seconded by John Portnoy; passed 5-0.   Supervisor:  Ed Simpson  

Hoeland, 1400 Chequessett Neck Rd., Map 18, Parcel 7, Certificate of Compliance.  Gordon Peabody represented the applicant and stated there are always problems with steps on the bluff.   Peabody recommended the owners of the property utilize the new design of steps that can be removed and installed on a seasonal basis in perpetuity.  He recommended renourishment and replanting beach grass.  Lauren McKean recused herself.  Ginie Page moved to approve the Certificate of Compliance; seconded by Barbara Brennessel; passed 4-0.    

Lay, 10 Pine Point Rd., Map 15, Parcel 131, NOI, septic upgrade.  David Lajoie represented the applicant with the site plans and explained the location of the wells, the wetlands and the buffer zones.  Chet Lay stated that the building will be sold and there is currently a cesspool system.  John Portnoy moved to approve the NOI; seconded by Barbara Brennessel; passed 5-0. 

Friends of Herring River, (Chequessett Yacht & Country Club), 680 Chequessett Neck Rd., Map 19, Parcel 81-4, RDA, Install 10 monitoring wells.  Lauren McKean recused herself.  Barbara Brennessel and John Portnoy are both on the Board of the Friends of Herring River committee.  There will be no conflict of interest with this proposal and By Necessity will vote due to a lack of a quorum.  Christine Odiaga gave an overview of the project and identified the locations of the monitoring wells.  USGS and the Country Club have an agreement on the project.   John Portnoy identified the RDA as a Negative 3; seconded by Ed Simpson; passed 4-0.       

Doyle, 1305 State Highway, Map 30, Parcel 159, RDA, remove pressure treated timber and some trees; replace with stone steps, construct walkway, new drywell, plant shrubs and perennials.  Charles Wentz represented the applicant and gave an overview of the project.  There will be 5 locust trees removed of which 4 are touching the wires to the house.   The shelled driveway will be extended with a permeable mixture for a turn around.  Native plants will be used for mitigation.  Bayberry will be planted at the edge of the driveway area near the marsh.  John Portnoy identified the RDA as a Negative 3; seconded by Ed Simpson; passed 5-0. 

Ginie moved to adjourn at 6:15 pm; seconded by John Portnoy; passed 5-0.
