Discuss Proposed Regulation Changes

No definition for “Cape Cod Lawn” and “Turf Lawns” in regulations – Agent Greenberg-Lemos is working on this.

Discussion regarding ecological restoration

Fees for small vessel identification and permitting will be changed to a flat fee of $100; seasonal and monthly fees will be eliminated.

Orleans includes vista pruning, pruning within buffer zones, and clear cutting in their regulations.  The Commission is in favor of including some these activities in Wellfleet’s regulations.

Meeting Minutes – to be reviewed at next meeting.

Hawes Pond:  site visit made and there is a violation.  The Town will talk with property owners prior to issuing any paperwork.

Agent Greenberg-Lemos updated the commission on activities at various properties in town.

Trudy Vermehren reported that there is debris at the back of Baker’s Field.  Americorps will be requested to assist in the clean-up.

Agent Greenberg-Lemos gave an overview of the Cape Coastal Conference she attended on December 6 and 7. .    

                                    

Public Hearings 5:00 pm:

Glaser & Husted, 49 Wigwam St., Map 35, Parcel 159:  Certificate of Compliance.  A letter was read from David Lajoie stating the project is in compliance.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 5-0.

Marschall, 45 Forrest Rd., Map 16, Parcel 619, Certificate of Compliance.  Trudy

Vermehren moved to approve the Certificate of Compliance; seconded by John Portnoy; passed 5-0.

Amsler Associates, 313 Main St., Map 14, Parcel 177, RDA, septic upgrade.  Jason Ellis represented the applicant and gave an overview of the project.  This project was approved by the Board of Health.  Barbara Brennessel identified the RDA as a Negative 3; seconded by Ali Sands; passed 5-0. 

Hay, 205 Commercial St., Map 21, Parcel 113, RDA, replace canvas awning with permanent porch, add decking to west side of building and relocate middle door to west side.  Mac Hay gave an overview of the project, stating the roof will be on both sides of the building and helical footings will be used.  He stated the project has received ZBA approval.  A new site plan is being worked on.  Trudy Vermehren requested additional information for the project, providing a new site plan which will identify where the footings will go and where the roofline will located, as well as water runoff from the roofline.  Trudy Vermehren moved to continue to January 4, 2017; seconded by Ginie Page; passed 5-0..          

Jorgenson, 305 Goss Lane, Map 36, Parcel 16.3, RDA, remove 6 pine trees, 2 oak, all pines with DBH under 4”, all oaks with DBH under 3”, prune Bear Oak limb(s).  A site visit was made by the commission.  The representative (Name or Company? gave an overview of the project.  A site plan did not provide the property lines.  No protocol was provided in regards to the work.  The commission stated they would like to see a vista corridor versus pruning on the entire back yard for a view.  The commission requested every tree be flagged so the commission can make another site visit on December 21, 2016.  Trudy Vermehren moved to continue to December 21, 2016; seconded by Barbara Brennessel; passed 5-0.         

Alexander, 49 Wigwam St., Map 35, Parcel 159, RDA, remove 2nd floor deck and remove trees touching house.  Mr. Alexander stated they are in the process of purchasing the property and they want to make improvements to the dwelling.  The deck will be replaced but located on the same footprint.  The commission requested additional information regarding the footing installation, how to protect the resources, what the work limit will be and how the resources will be protected.  Since the roofline will be changed, the commission is requesting information regarding downspouts to dry wells.  Trudy Vermehren moved to continue to December 21, 2016; seconded by Ali Sands; passed 5-0.   

Murphy, 151 Hamblin Farm Rd., Map 19, Parcel 12, lots A & B, NOI, construct paved driveway and drainage.  Gordon Peabody represented the applicant and stated this is an access to divided property.  This was previously approved in 2003 but work was not started.  The drains are for a 25-year storm event.  Bruce McGibbon, abutter, stated there is no fresh marsh and he gave some history of the properties and his interpretation of wetland boundaries near the site.  The commission felt that Mr. McGibbon’s concerns did not apply to this project.  (Ali Sands had to leave the meeting at 6:15 pm.)  Trudy Vermehren moved to approve the NOI; seconded by Ginie Page; passed 4-0.  A new site plan will be provided.  Supervisor:  Ginie Page

Barbara Brennessel moved to adjourn at 6:15; seconded by John Portnoy; passed 4-0.
