Meeting Minutes

4:00 - Business Meeting & Conservation Agent's Report

Ed Simpson was Acting Chair. 

There was discussion regarding some violations and letters Agent Greenberg-Lemos had sent to property owners.

Letter from Board of Selectmen regarding town owned land.  A letter from the Assistant Town Administrator was also read regarding town owned land, property owners, a bulk head and Pleasant Point.   

            Moby Dick’s:  Todd Barry and Attorney Bierhan attended the meeting.  Acting Chair Ed Simpson reviewed the previous correspondence and orders issued to the owner of Moby Dick’s.  There was discussion regarding corn husks, the extent of the boundaries of the parking lot, and debris in the marsh as well as the need for an as-built plan  of the parking lot.  Todd stated he would have a surveyor perform the as-built of the parking lot. 

            The commission discussed the bulkhead and town owned land on Pleasant Point.

            Agent Greenberg-Lemos stated they would review the regulations for small vessel identification and permitting,  and habitat restoration at the next meeting.

Meeting Minutes – Nov. 2, 2016.  Barbara Brennessel moved to approve the amended meeting minutes; seconded by John Portnoy, passed 5-0.

                           

Public Hearings 5:00 pm:

Town of Wellfleet, Kendrick Ave, Maps 21 and 20, Parcels 114 and 31:  NOI, Wellfleet Harbor Dredging.    The Town requested a continuation to 12/07/16.  Ginie Page moved to continue to 12/07/16; seconded by Barbara Brennessel; passed 4-0.

Meredith, 45 Old Truro Rd., Map 8, Parcel 252, Certificate of Compliance.  A site visit was made and the project is in compliance.  John Portnoy moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 4-0.

Grandin, 22 Kendrick Ave., Map 21, Parcel 110, Certificate of Compliance.  This project is in compliance.  Ginie Page moved to approve the Certificate of Compliance; seconded by Barbara Brennessel; passed 4-0.

Scott, 345 Pilgrim Spring Rd., Map 29, Parcel 240, Certificate of Compliance.  This project was from 1994, and a letter (from whom?) was received that the project is in compliance.  John Portnoy moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 4-0.

Yudowitz, 75 Omaha Rd., Map 28, Parcel 189, Certificate of Compliance.  A site visit was made and the project is in compliance.  Barbara Brennessel moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 4-0. 

Rossi, 30 Buttry Way, Map 16, Parcel 633, RDA, septic upgrade.  David Lajoie represented the applicant and gave an overview of the project.  John Portnoy identified the project as a Negative 2; seconded by Barbara Brennessel; passed 4-0.

Perot, 36 Indian Neck Rd., Map 28, Parcel 45, Request for Amended Order of Conditions:  enlarge driveway and construct retaining wall.  Laura Kelley represented the applicant and gave an overview of the project.  Boulders will be relocated.  Ed Simpson moved to approve the Request for amended Order of Conditions; seconded by Ginie Page; passed 4-0.

Flattery, 479 Black Pond Rd., Map 4, Parcel 38, NOI, replace wood stairs with stone stairs (Cont’d).   There was no representation or new paperwork for the hearing.   Agent Greenberg-Lemos stated the applicant must pay a $5.00 fee for all (all or each?) the continuations requested.   The original application was received in May 2016.  John Portnoy moved to deny the NOI; seconded by Barbara Brennessel; passed 4-0.   Agent Greenberg-Lemos will send an enforcement order to remove the upper rocks within the commission’s jurisdiction.    

Cooney, 3 Kendrick Ave., Map 21, Parcel 112, AOOC, Change foundation, modify footprint of dwelling, and place utilities underground (Cont’d).  Mr. Cooney gave an overview of the new site plan and drawings for the foundation.  Ginie Page moved to approve the AOOC; seconded by John Portnoy; passed 4-0.

AJOR, 6325 Chequessett Neck Rd., Map 19, Parcel 117, NOI, remove pool, replace with new pool and patio with mid-level deck.  Peter White represented the applicant.  An overview of the project was given, stating the applicant took into consideration the concerns the commission previously had.  There will be no activity in the 50-foot buffer zone.  The run off will be directed to a sub-surface system.  The patio located on the west side of the pool will be wet-set material.  A wooden deck will be installed on the east side of the pool.  The drainage run-off has been designed so nothing goes into the 50 foot buffer zone.  Landscape features were discussed.  The commission questioned the removal of trees in the past and the evidence that nothing had been replanted, which could promote erosion and be detrimental in storms.  There will be a pergola and fireplace within the patio area.  The outside shower water will be directed to the sub-surface system.  The project has been pulled back 5 ½ feet away from the 50-foot buffer zone.  The commission expressed concerns about the size of the project, the decking, access to the pool with equipment, and potential damage to the resources.  The commission requested a deconstruction protocol and construction protocol, as well as any potential changes.  DEP had not supplied a number.  Ed Simpson moved to continue to 12/7/16; seconded by Ginie Page; passed 4-0.  

Gardner, 87 Gull Haven Ln., Map 9, Parcel 620, RDA, Installation of new well and Title 5 septic system. Only the new well will be within the buffer zone.  David Lajoie represented the applicant and gave an overview of the project.  Ginie Page identified the project as a Negative 3; seconded by John Portnoy; passed 4-0.

Ed Simpson moved to adjourn at 6:30 pm; seconded by Ginie Page; passed 4-0.
