Minutes of Meeting of September 12, 2018

Senior Center, Duck Pond Room, 7:00 p.m.

                                                                                                                                    

Present:  Ken Granlund Jr., Chair; Moe Barocas, Janet Drohan, Gary Locke, Nick Picariello; Health Agent Hillary Greenberg-Lemos, and Mary Rogers, Committee Secretary

Ken Granlund called the meeting to order at 7:00 p.m.

Variance Request

Matthew Farrell of J. M. O’Reilly & Associates presented, as requested in the letter dated   September 12, 2018, the J. M. O’Reilly Plan #JMO -6600, dated September 11, 2018, for one (1) variances for the proposed upgrade from an existing failed leaching facility to a title 5 sewage disposal system for Bill and Lucy Buckley at 50 Way #68 Wellfleet (Map 21, Parcel 36):

  1. Proposed S.A.S. within 3’ of finish grade 6’ held,  3’ variance

The variance is required due to the small lot size and existing well and wetland areas.  The new leaching facility is to be under the driveway and cannot be graded to meet minimum cover requirements.  Mr. Farrell explained the vent system for the leaching facility.

Gary Locke moved to approve the J.M. O’Reilly plan #JMO-6600, dated September 11, 2018, as requested in letter dated September 12, 2018 for the upgrade of a septic system to serve a 3-bedroom house and grant the one variance with the following conditions:

  1. Design flow is to be limited to 333 GPD to serve three (3) bedrooms.
  2. No increase in habitable area without Board of Health review.        
  3. There is to be no conversion of use without Board of Health review. 
  4. The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and the well shall be tested and found potable, with results copied to the Health Department, prior to the issuance of the Disposal Works Permit.
  5. Bi-annual pump out of the existing 1000-gallon septic tank is required, with log of septage disposal copied to the Health Department.
  6. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
  7. Annual inspection of pumps, alarms and other equipment including distribution lines with results submitted to the Health Office by January 31 of each year.
  8. Pumps, alarms and other equipment requiring periodic or routine inspection and maintenance shall be operated, inspected and maintained in accordance with the manufacturer’s and the designer’s specifications and Department guidance.  The system owner shall submit the results of such inspections to the local Approving Authority annually by January 31st of each year for the previous calendar year.

Moe Barocas seconded, and the motion carried 5-0. 

Business

Nick Picariello brought it to the Board’s attention that someone is living in a trailer behind the Mobil Station.   Hillary Lemos said there had been a number of complaints about trailers this summer.  Gary Locke suggested more regulations to give the Health Agent more authority over enforcement of the zoning bylaw that exclude habitation in trailers.

Janet Drohan discussed the rodent problem in Cape towns.  Birdseed is an attraction for them, she said.  Bob Prescott of Audubon’s Wellfleet Wildlife Sanctuary, in cooperation with Mike O’Connor of Birdwatchers General Store, will be testing a double tray bird feeder for ecological bird feeding.  Another suggestion is to request provisions for rodent control with farm permits.   After conducting further research, the Board of Health maybe able to place an informational insert in a future tax bill. 

Health Agent Hillary Lemos asked about emergency situations that need variances, requesting a go ahead to install an upgrade before a Board of Health meeting.   The Board of Health said the Health Agent should do this. 

Correspondence

Hillary Lemos reviewed an assortment of letters on health issues, septic systems, wells, notifications and complaints that had been brought to her attention. 

Minutes

Gary Locke moved to approve the amended minutes of July 11, 2018.  Moe Barocas seconded, and the motion carried 3-0.

Gary Locke moved to adjourn.  Moe Barocas seconded, and the motion carried 5-0.
