Acting Chair Drohan called the meeting to order at 7:00 p.m.

Variances- 

Siegel-210 Baker Avenue

David Lajoie of Felco Engineering presented, as requested in the letter of July 27, 2017, FELCO, Inc. Plan #17040, dated July 17, 2017, two variances for the upgrade of a septic system under an existing dwelling owned by Susan Siegel at 210 Baker Avenue (Map 14, Parcel 183):

  1. 6’+ from existing septic tank to cellar wall-310 CMR 15.211
  2. 11’+ from existing leach area to cellar well

FELCO, Inc. requested a continuance, and come back with a revised plan scaling back the foundation to maintain 10’ from cellar wall to tank and 20’ from cellar wall to leach field.and move the leaching area. Tabled for a future meeting.

There was no motion.

DiBianco, 52 Ione Road (Map 28, Parcel 63)

David Lajoie of Felco Engineering presented, as requested in the letter of July 27, 2017, FELCO, Inc. Plan #17037, dated July 11, 2017, thirteen variances for the installation of a new subsurface septic system owned by Joseph & Phyllis DiBianco, 52 Ione Road (Map 28, Parcel 63):

  1. 32’ from septic tank to well Parcel (64)-310 CMR 15.211
  2. 10’ from septic tank to well (Parcel 55)
  3. 2’ from septic tank to well (Parcel 64)
  4. 4’ from septic tank to property line (Parcel 64)
  5. 4’ from leach area to property line (Parcel 64)
  6. 12’ from leach area to cellar wall (locus)
  7. 56’ from leach area to well (Parcel 64)
  8. 14’ from leach area to well (Parcel 65)
  9. 32’ from leach area to well (Parcel 62)
  10. 21’ from leach area to well (Parcel 65)
  11. 59’ from leach area to well (Locus)

Locke moved to approve FELCO Plan 17037 dated July 11, 2017 and grant the thirteen (13) variances requested in the letter dated July 27, 2017 for the installation of a new subsurface septic system to serve a 4-bedroom dwelling at 52 Ione Road (Map 28, Parcel 63) under using ADVANTAX-AX20 denitrification technology under the use provisional approval conditions.

Barocas seconded, and the motion carried 4-0.

Business

JM O’Reilly & Associates-Discussion-DSD 17-03, 125 Marven Way (Assessor’s Map 21, Parcel 26)

Matt Farrell is requesting approval on the subdivision located at 125 Marven Way with the condition that no variances are granted on either lot for any septic or well-work. He explained that Lot 1 is served by two one-bedroom studios, an existing septic system, and a proposed well on the Northeast Corner. Lot 2 is served by an existing five-bedroom dwelling, an existing well Southeast of the dwelling, and a proposed sewage system North by Northwest.

The Board of Health discussed variances for new construction at 125 Marven Way Map/Parcel21/26 are highly discouraged, in compliance with 310 CM.

Locke moved to approve and Drohan seconded. The motion carried 4-0.

Gerry and Audrey Parent-125 Duck Pond Road

Attorney Ben Zehnder was present to ask the Board to remove the restriction of limiting the amount of female alpacas.

Lemos reported that she visited 125 Duck Pond Road on August 1st and 4th. On August 1st the Health Department verified there were 35 female alpacas closest to the McDonald’s property Map 25/Parcel 84.2. The animals were over 100 feet from the well, there was a temporary fence in place, and the 21 male alpacas were in Pen 3. On both visits, there was minimal smell and minimal dust.

Elizabeth McDonald said that with the reversal of the animals/swapping of the pens, there has been improvement, but there is still concern about the well and fluctuating nitrate levels. The temporary fencing has a gate that opens and closes, but they’d like to see a permanent fence installed.

Lemos restated that the Parents are permitted to have 57 alpacas. The first pen, closest to the McDonald’s is empty, the second pen houses the 35 females, and the third pen houses the 21 males. The Board discussed the 15 vs 35 animals located in pen two. It was determined that since the animals are now located 100 feet away from the well, then the well should be given the opportunity to work with that distance rule in place. Parent suggested bringing in 100 yards of fill into pen 1 to delete or eliminate any run off.

Drohan closed the public comment at 8:09

Locke moved to approve the 35 females in pen two, no closer than a hundred feet to the abutter’s well, with well-water testing every six-months, beginning in December 2017.

Seconded by Picariello

Drohan opposed. The motion carried 3-0-1.
