 Minutes of Meeting of February 8, 2017

Senior Center, Duck Pond Room, 7:00 p.m.

Chair Ken Granlund called the meeting to order at 7:00 p.m. 

Variance - Sullivan Realty Trust, 136 Rockwell Ave.

David Lajoie of Felco Engineering presented, as requested in the letter dated January 24, 2017, Felco Plan #16085 dated January 1, 2017 and revised on January 31, 2017 for three variances for the existing house owned by Sullivan Realty Trust at 136 Rockwell Ave. (Map 25, Parcel 15):

  1. 4’ from leach area to property line (street) CMR 15.211
  2. 4’ from leach area to property line (C.C.N.S.)
  3. 14% reduction in leach area capacity provided – 310 CMR 15.404 (2)d)

Janet Drohan moved to approve the three variances for Felco Plan #16085 dated 1/31/17 and grant 3 variances requested in the letter of 1/24/17 for the upgrade of an existing structure to serve at 3-bedroom structure at 136 Rockwell Ave. with the following conditions:

  1. Design flow is to be limited to 330 GPD.
  2. 14% reduction in size of the leach area
  3. No increase in habitable area without Board of Health review.
  4. There is to be no conversion of use without Board of Health review. 
  5. The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  6. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of conditions deed recorded shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

Moe Barocas  seconded, and the motion carried 3-0.

Variance Request & Definitive Subdivision Plans for Hall. 325 Old King’s Highway 

The Board of Health members reviewed the Definitive Subdivision plans for 325 Old King’s Highway (Map 23, Parcel 73), and Chester Lay of Slade Associates explained his request in the letter dated February 6, 2017 for a variance for the 9-lot subdivision having an area of 9.57 acres, for an overall density of 1.06 acres per lot.  The average lot size is 41,980 square feet, well above the minimum required lot size of 30,000 square feet.  The provision of Title 5, limiting development to one bedroom for each 10,000 square feet apply to the subdivision, he said.   Natural Heritage has restricted development on significant portions of each lots for endangered species protection.  Because of all of this, he stated that the design of the development addresses the concerns of Board of Health Regulation 0404 for hydrogeological study and should receive a variance from Regulation 0404.

John Cumbler moved to grant the variance for  the Regulation 0404 hydrogeological study and approve the master well septic system as requested in the letter dated February 6, 2017 from Chester Lay of Slade Associates for the Definitive Subdivision Plan dated September 27, 2007 as revised on November 7, 2016 for the lot on Assessor’s Map23, Parcel 73 at 325 Old King’s Highway registered as L.C.C. No. 43289.  Janet Drohan seconded, and the motion carried 4-0.

Discussion with Recycling Committee

Lydia Vivante, Beth Brehmer, Lonni Briggs from the Recycling Committee were present to discuss a number of their committee’s efforts.  Lydia Vivante discussed ideas for a better Swap Shop building.  She said a new building will be more stable, but the Recycling Committee hopes to make it a “green” building.   She suggested holding a site visit with the Board of Health for a new layout of buildings at the Transfer Station.  Ms. Vivante also informed the Board about initiatives by Gabrielle Grifiths to encourage co-safe sunscreen and other personal care products.  The Board wanted to be involved in an educational process for the initiative.  Lydia Vivante recommended the Recycling Committee’s new website wellfleetrecycles.org.

Beth Brehmer said she was concerned about Styrofoam use in Wellfleet.  It is not recyclable and is very dangerous when it gets in the water.  Lonni Briggs displayed a number of substitute products.  She said the Recycling Committee wants to move on to banning polystyrene products.  They are proposing a bylaw through the Wellfleet Disposable and Single-use Goods Warrant Article for ATM 2017.  The following year would target restaurant take-out containers.  their goal is to have eliminated polystyrene by 2018 and all petroleum-based plastics by 2019, she said.    Bioplastics that get burned do not produce toxic fumes or residue.  Ms. Briggs said that the little businesses in Wellfleet are making efforts to go “green.”  She outlined some of their plans to increase awareness of their initiative to ban polystyrene and plastics. 

Janet Drohan advocated for an intense educational program.  John Cumbler asked about the wisdom of putting all parts of their program to into this year’s Town Warrant.  Janet Drohan discussed the dichotomy of plastic use during the seasons.  Beth Brehmer said many businesses would promote themselves as green businesses.  Ken Granlund said he expected there would be push back on the bylaw to ban polystyrene and plastics.

Board of Health members approved and signed licenses before them.

John Cumbler moved to adjourn.   Moe Barocas seconded, and the motion carried 4-0. The meeting was adjourned at 8:05 p.m.
